THE BARKER BOYS Pty Ltd TERMS AND CONDITIONS OF SALE The following terms and conditions govern the supply of goods that we offer to our customers: 1. Prices a) Orders are accepted on the condition that prices charged are those ruling at the time of despatch. b) Goods and Services Tax (GST) is applicable to all goods sold. c) Prices include postage and handling, and GST. 2. Delivery a) Whilst every endeavour will be made to deliver the goods within five (5) working days, this may not be taken as implying any legal obligation to do so. b) All goods must be delivered to a specified premises and receipt of such goods must be acknowledged by signature of the recipient. c) Following the provision by you of delivery location details for an order, you may not contact our approved carrier and authorise them to deliver the goods to another address. 3. Claims a) Liability for damage to goods in transit will not be accepted unless notification is made within seven (7) days after delivery. 4. Return of Goods a) The Barker Boys Pty Ltd will not accept the return of goods except in the following circumstances: - goods are of faulty manufacture - goods were not ordered - a duplicated order. b) Goods for return must have prior approval and must only be consigned through our approved carrier. c) Issuing of a return authority does not imply acceptance of a refund claim. d) Goods purchased over 12 months previously are non-returnable. 5. Trade Practices Act Subject to the rights conferred by any State Law or the Trade Practices Act 1974, all conditions and warranties which might be implied in the supply of any goods by The Barker Boys Pty Ltd are hereby excluded and negated to the extent permitted by law and to the extent that the Trade Practices Act 1974 permits The Barker Boys Pty Ltd to lessen its liability for a breach of condition or warranty, then liability is limited to replacement of the goods. |
